What Is A Trust?

A revocable living trust is an agreement between the Trustors, the individuals creating the Trust, and the Trustees, the individual(s) named by the Trustors to hold and manage the Trust property. The Trustors and the Trustees can be and often are the same individuals. Trustors also name beneficiaries or individuals that receive property or otherwise benefit from the trust during the Trustors’ lives or after death. Clients are often the Trustors, Trustees and current beneficiaries of their revocable living trust.

Do I Need A Trust?

Trusts are attractive because they allow you to avoid the time and expense of probate, which in Washington generally takes more than five months to complete and routinely costs more than $4000. Trusts, unlike wills, also allow Trustors to keep their financial affairs private following death, as Wills are filed with the Court and become public record. Trusts also lock estate administration fees in today’s dollars as there is no need for probate 20 years down the road (with the subsequent inflation of attorney fees). We will discuss with you the pros and cons of using a will versus trust in your estate planning and which document would work the best for you and your family goals.
